Ever since the first successful mind reading, and the subsequent first successful Darkworm infestation, the law of the Empire was that it was only used after someone was found guilty of a major crime via traditional means, to confirm their guilt before they were executed. That way if their brains were consumed by otherworld Darkworms, it probably didn't matter.
Of course, it was known to the Queen and the High Judges and the Grand Witches that Darkworms were exclusively lured to innocent minds exposed to their sight. But they kept that quiet, saved on compensation to claim they were guilty.
